RTPR definitively secures over EUR 1.7 million for an NGO-sector client, following the annulment of 80 sale contracts in a property dispute involving more than 90 defendants

RTPR successfully assisted a client from the non-governmental organisations (NGO) sector, who acted as claimant in an extremely complex dispute, definitively settled by the High Court of Cassation and Justice after more than five years, concerning the annulment of 80 sale contracts and the restoration of the parties to their prior position—an approach that led to the client obtaining an amount exceeding EUR 1.7 million. . . . 

The final decision was delivered in a case involving more than 90 defendants, with the courts at all procedural stages upholding the arguments advanced by RTPR and ordering the nullity of the contracts and the restoration of the prior position. 

The complexity of the dispute was further compounded by the fact that some of the defendants filed counterclaims, which required rigorous procedural management and an integrated legal approach to all claims brought before the court.

The dispute also raised complex legal issues in the sphere of special property legislation, requiring the interpretation and application of special rules in correlation with the general principles governing the validity of legal acts and their effects.

The RTPR team provided legal assistance throughout the entire proceedings, from defining the litigation strategy to representing the client at all procedural stages.

This outcome confirms RTPR’s expertise in highly complex, long-running property disputes involving multiple parties and substantial financial stakes.

Given the existence of more than 90 defendants and a significant number of contested contracts, severance would have generated major risks of inconsistent case law, contradictory solutions, and an excessive prolongation of the proceedings. The adopted strategy sought to ensure a coherent and unitary examination of the legal relationships submitted to the court, enabling the court to conduct an overall analysis of the validity of the contracts and their effects.”
